Hovercontrol.com Multi-User Flight Environment - Terms of Service It is very important that you take the time to read these terms and conditions, and understand how they apply to your use of Hovercontrol.com's services. Use of the Hovercontrol.com Multi-User Flight Environment constitutes your agreement with these terms. IN THESE TERMS AND CONDITIONS, "WE," "US," "ITS" AND "OUR" REFER TO HOVERCONTROL.COM, AND "YOU" AND "YOUR" REFER TO YOU. Before using Hovercontrol.com's Multi-User Flight Environment, please read this agreement relating to your use of our services carefully.
By using Hovercontrol.com's Multi-User Flight Environment, you agree to be bound by these terms and conditions of use ("Terms"). If you do not agree to these Terms, please do not use this service. Hovercontrol.com provides the information and services of the Hovercontrol multi-user flight environment to you, the user, conditioned upon your acceptance, without modification, of the Terms contained herein. Your use of Hovercontrol.com's Multi-User Flight Environment constitutes your agreement with such Terms. We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms periodically. Such modifications shall be effective immediately upon posting of the modified Terms. Your continued use of the Hovercontrol mult-user flight environment website following the posting of changes to these Terms will mean that you accept those changes. In addition, use of Hovercontrol.com's Multi-User Flight Environment and/or its Services constitutes full acceptance of and agreement to the Terms; if a user does not accept our Terms, he or she is not granted rights to use Hovercontrol.com Multi-User Flight Environment or any of its Services, as defined herein, and should refrain from accessing Hovercontrol.com Multi-User Flight Environment and its Services. To update the Terms, we will post the changed version and each user of the Hovercontrol Mult-User Flight Environment will be asked to review and agree to the updated terms of service. Hovercontrol.com reserves the right at any time to modify or discontinue, temporarily or permanently, any Service thereon (or any part thereof). Hovercontrol.com shall not be liable to any user or other third party for any such modification, suspension or discontinuance except as expressly provided herein.
2. NO UNLAWFUL, PROHIBITED, DISRUPTIVE, OR MALICIOUS USE By using the Hovercontrol Multi-User Flight Environment, you warrant to Hovercontrol.com that you will not use Hovercontrol.com, The Hovercontrol Multi-User Flight Environment, or any of the content obtained from Hovercontrol.com services, for any purpose that is unlawful or prohibited by these Terms. If you violate any of these Terms, your permission to use Hovercontrol.com and Hovercontrol.com Multi-User Flight Environment automatically terminates. In addition, by using the Hovercontrol Multi-User Flight Environment, you warrant to Hovercontrol.com that you will not use Hovercontrol.com, The Hovercontrol Multi-User Flight Environment, or any of the services provided by Hovercontrol.com for disruptive or malicious purposes. If, after investigation, we have reasonable grounds to suspect that a user is participating in, or party to disruptive or malicious activities we will suspend or terminate that user's account (with or without notice or explanation) and prohibit any and all current or future use of the Services.
This Multi-User Flight environment is owned and operated by Hovercontrol.com for the purposes of providing a disruption-free helicopter flight training environment to Hovercontrol.com members, and to foster a professional atmosphere where multi-user flight simulation activities can be enjoyed by mature helicopter flight simulation enthusiasts. Use of Hovercontrol's Multi-User Flight Environment for any purpose other than that described above is a violation of these terms. You are soley responsible for ensuring that your actions, activities, and communications as they relate to this service are compatible with, and consistent with the description of this service and that they are not in violation of any other terms.
4. YOUNG ADULT AND NON-ENGLISH SPEAKING USERS Hovercontrol.com is committed to providing an environment that is suitable for all ages, as well as to members from all parts of the world. However, understanding and abiding by the terms of service for the Hovercontrol Multi-User Flight environment will, at all times, be the responsibility of the user. The user's understanding and agreement to these terms are assumed by use of Hovercontrol.com's Multi-User Flight Environment regardless of the user's age or ability to understand written, or spoken English.
As required by HOVERCONTROL.COM, each user must: (a) provide true, accurate, current and complete information on the Hovercontrol.com registration form (collectively, the "Registration Data") and (b) maintain and promptly update the Registration Data as necessary. If, after investigation, we have reasonable grounds to suspect that any user's information is untrue, inaccurate, not current or incomplete, we may suspend or terminate that user's account and prohibit any and all current or future use of the Services (or any portion thereof) by that user other than as expressly provided herein. Each user will receive a password and account designation upon completing HOVERCONTROL.COM registration process and is wholly responsible for maintaining the confidentiality thereof and wholly liable for all activities occurring thereunder. HOVERCONTROL.COM cannot and will not be liable for any loss or damage arising from a user's failure to comply with this Section, including any loss or damage arising from any user's failure to (a) immediately notify HOVERCONTROL.COM of any unauthorized use of his or her password or account or any other breach of security and (b) ensure that he or she exits from his or her account at the end of each session.
You agree not to sell, resell or offer for any commercial purposes, any portion of the Services, use of the Services or access to the Services.
We may terminate a HOVERCONTROL.COM user's account in our absolute discretion and for any reason. We are especially likely to terminate for reasons that include, but are not limited to, the following: 1.) violation of these Terms; 2.) abuse of site resources or attempt to gain unauthorized entry to the site or site resources; 3.) use of Hovercontrol.com or any Hovercontrol.com Service (including the Multi-User Flight Environment) in a manner inconsistent with the Purpose as described in the description of service; 4.) Use of foul, objectionable, or controversial language in written or spoken communications; 5.) communications or activities that are consistently at the boundary of what is permissable by these terms of service, but not necessarily specifically prohibited; 6.) communications or activities that are intended to cause, encourage, or otherwise expand personal conflict between or among any party or parties; 7.) communications or activities that are intended to, or consistently appear to have the intention of testing the terms of service 8.) a user's request for such termination; and 9.) requirement of applicable law, regulation, court or governing agency order. Our termination of any user's access to Hovercontrol.com or any Service hereunder may be effected without notice and, on such termination, we may immediately deactivate or delete user's account and/or bar any further access to such services, servers, files, or any other resource. Hovercontrol.com shall not be liable to any Hovercontrol.com user or other third party for any termination of that user's Hovercontrol.com or Hovercontrol.com Multi-User Flight Environment access or account hereunder.
Hovercontrol.com, or any Service or a third party may provide links to other websites. Hovercontrol.com exercises no control whatsoever over such other non-Hovercontrol.com websites and web-based resources and is not responsible or liable for the availability thereof or the content, advertising, products or other materials thereon. Hovercontrol.com shall not be responsible or liable, directly or indirectly, for any damage or loss incurred or suffered by any user in connection therewith. Your access and use of websites linked to Hovercontrol.com, including information, material, products and services therein, is solely at your own risk.
Each user shall indemnify, defend and hold harmless HOVERCONTROL.COM, its subsidiaries and affiliates and their respective officers, employees and agents, and each of HOVERCONTROL.COM's website partners from any and all claims, demands, damages, costs and liabilities, including reasonable attorneys' fees, made by any third party due to or arising out of that user's acts or omissions, including claims arising out of that user's use of HOVERCONTROL.COM; his or her submission, posting or transmission of Content or his or her violation of the Terms.
EACH USER'S USE OF HOVERCONTROL.COM AND HOVERCONTROL.COM SERVICES IS AT HIS OR HER SOLE RISK. WE RESERVE THE RIGHT TO REPORT ANY MALFEASANCE THAT COMES TO OUR ATTENTION TO THE APPROPRIATE AUTHORITIES. WE DO NOT GUARANTEE CONTINUOUS UNINTERRUPTED OR SECURE ACCESS TO HOVERCONTROL.COM OR ANY SERVICES. IN NO EVENT SHALL HOVERCONTROL.COM, OUR SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR OUR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH HOVERCONTROL.COM, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE).
In the event that you have a dispute with one or more Hovercontrol.com users, you release Hovercontrol.com (and our officers, directors, agents, subsidiaries, parent corporation, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
Without limiting any other remedies, Hovercontrol.com may suspend or terminate your Hovercontrol.com account if we suspect that you have engaged in fraudulent activity in connection with Hovercontrol.com or any Hovercontrol.com Service.
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of Hovercontrol.com and all of its Services, including the Multi-User Flight Environment.
You and Hovercontrol.com are independent entities, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by these Terms.
The Terms constitute the entire agreement between each user and Hovercontrol.com and govern each user's use of the Service, superseding any prior agreements. Each user may be subject to additional terms and conditions that may apply when that user uses affiliate services, third party content or third party software. |

activities, and communications as they relate to this service are
compatible with, and consistent with the description of this service and
that they are not in violation of any other terms. Members who want to enjoy the multi-user flight environment
at Hovercontrol often have questions about what activities they
should avoid in order to not unintentionally cause disruptions while
using the environment. It is safe to say that if a user intends to
have a professional and courteous attitude while visiting our environment,
and consistently shows respect to other members while going about their
activities, they will not have many problems in regard to the terms of
service. Because of the complexity of a simulated world environment,
it is not practical to attempt to list every activity a user should
avoid. However, the following items will help a user to ensure
that they are participating in a way that is compatible with the terms of
service. 1. WHAT CALLSIGN
SHOULD I USE FOR MY FSINN CONNECTION TO HOVERCONTROL? When you set up your connection using your FSInn client
software, you will have to provide your real name, as well as
a callsign. Every member of Hovercontrol has a callsign that has been
generated at the time of their registration. For example, yours can
be found when visiting the "Your Control Panel" link in the Hovercontrol
message forums. If you are accustomed to using this callsign for
your online flying activities, you may feel free to continue using your
Hovercontrol callsign for your flights while connected to this
environment. However, you may also use a callsign of your own
choosing. Keep in mind, that while flying, other pilots will
see your callsign as a label that is positioned above your aircraft.
If you would like other members to be able to visually identify you in
flight, a descriptive callsign will help you. Your callsign, as
entered into your FSInn client program before connecting, is limited
to 7 Characters. Examples of effective callsigns include: HC383TR,
N075BL, C456UT, and N453AC. Maintaining a professionally
courteous callsign is your responsibility, and is required by the terms of
service. If in doubt, you should opt to use your Hovercontrol.com
callsign. 2.
WHAT NICKNAME SHOULD I USE FOR MY TEAMSPEAK CONNECTION TO HOVERCONTROL? Each user has a their own login and password, however you will need to
enter a nickname when connecting to teamspeak. You may choose your own teamspeak nickname. Keeping in mind that
other members in the environment will expect to be able to address you by
looking at your teamspeak nickname. Your nickname should be clear
and easy to understand, and should include the name that you would wish
others to address you by. Nicknames that do not offer
other members a polite way to address you are not considered
professional or courteous. Examples of effective nicknames for
Teamspeak include: HC383TR_Jim, N075BL_Chris, BobSmith-Student,
and Roger-ImNewHere. Maintaining a professionally courteous nickname
is your responsibility, and is required by the terms of service. If
in doubt, you should opt to use your Hovercontrol.com callsign followed by
your first name, so that others may address you in a courteous
manner. 3. DO I
NEED TO FOLLOW REAL-WORLD FLYING PROCEDURES REGARDING AIRSPACE AND
AIRPORTS? In short, Yes. We understand that not everyone
using this environment is at the same level of experience or skill when it
comes to operating their aircraft in accordance with general real-world
procedures. However, many of the people you will be flying with will
have experience with real world flying, and they will be expecting
professional and courteous actions on your part. If you are new to
flying in a multi-user environment, and have no real-world experience, you
will have a great opportunity to learn from those around you. You
will also have the responsibility of not disrupting the activities of
others around you. It is your responsibility to not cause
disruptions, this includes (but is not limited to): 1.) using clear radio
and/or text calls to communicate intentions; 2.) Entering and
exiting airport or other operating areas in a structured and well
communicated fashion; 3.) coordinating ground movements in a
careful and well communicated fashion; 4.) and limiting your flight
activities to those that are appropriate for your skill level, aircraft
type, and location. You will be expected to treat flight related
facilities as important areas that require your attention
and courteous operation to avoid disrupting other
members. This includes communicating your intentions to
others around you, in a courteous and concise manner via teamspeak or the
appropriate chat facilities within FSInn. You will also be expected
to treat all ground environments such as runways, taxi-ways, tarmacs,
and helipads with the same level of care and courtesy that you would be
expected to demonstrate during real-world operations. This
includes the slow and careful movement of your aircraft, in a manner that
does not disrupt other pilots, and that does not create the possibility of
collision with other aircraft around you. If you are a student
pilot, and unable to control the operation of your aircraft, you should be
very careful about attempting to operate near popular locations, or where
others are located. An inability to control your aircraft or
effectively communicate with others will not excuse you from the
expectation of courteous and professional operations. 4. ARE
THERE ANY RESTRICTED AREAS OR AIRSPACE? Yes. KMSO and 4S2. There are two airport
locations where special limitations will apply. Hood River Oregon
(Id: 4S2) and Missoula Montana (Id: KMSO). These airports are used
for specific purposes at Hovercontrol. Aircraft types other
than helicopter and general aviation are not permitted within 100nm of
these airports while connected to our environment. General aviation
aircraft will include piston and turbo-prop powered aircraft (single or
twin engine) of sizes not greater than a Beechcraft Kingair 350 and not
weighing more than 10,000lbs. When entering, exiting, or
operating near these areas, special care should be used
to ensure that your activities will not cause disruption
of other flight and training activities. Alternative
flight operations such as aerobatic display, or simulated military
operations may not be performed in these restricted areas. It
is important that you understand where these areas are, and the
restrictions that apply. 5. WHAT AIRCRAFT MAY I FLY WHILE CONNECTED TO THIS ENVIRONMENT? You may operate any aircraft you choose while connected to
this environment. However, you will need to carefully consider
whether your aircraft is appropriate for your location as well as
your own ability to operate a particular aircraft in a professional and
courteous manner. You should also take a moment to review item #3
and #4 above, as your courteous and professional communication and actions
are expected, regardless of aircraft type, or location. You should
take a moment to consider the purpose of this environment (at the top of
this page) and consider wisely whether your aircraft, and your
ability to operate it properly will cause a disruption for others, or
even give the appearance of having the intention to cause a
disruption. If you are professional and courteous in
regards to your activities and choose appropriate aircraft for the
locations you visit, you will be able to enjoy a wide variety of aircraft
in this environment. It is important that you carefully
consider your choices, and understand any limitations that apply for
your location. 6.
CAN I FLY FORMATIONS, MISSIONS, OR SIMULATED MILITARY OPERATIONS WHILE
CONNECTED TO THIS ENVIRONMENT? Yes you may. However, it is your responsibility to
participate in any activity in such a way that it does not cause a
disruption to the flight operations of others. This applies to all
aspects of your operations, including communications. Your
professional and courteous actions are expected regardless of activity, or
location. You will need to consider carefully your choices when
choosing to participate in this type of activity. Your activity
should never cause disruption, or even give the appearance of
having the intention to cause a disruption, to any normal flight
operations, regardless of location or purpose of your activity. The
possibility of causing disruptions when flying missions, simulated
military operations, or other alternative flight operations is high,
so users that choose to participate in these activities should be
experienced in the environment, be able to communicate well with others,
and be very familiar with the terms of service and the items covered in
this FAQ. If you are new to the environment, and in the process of
familiarizing yourself with proper communications and flight operations,
these types of activities are not recommended. 7.
HOW DO I KNOW IF WHAT I AM DOING IS ACCEPTABLE, OR MIGHT CAUSE DISRUPTION WITH
OTHERS? If you are not able to easily answer this question for
yourself, it is a good sign that you might be doing something that will
cause a disruption to the flight operations of other members. Normal
flight operation consitutes flying an appropriate aircraft for your skill
level and location, as well as acting and communicating with others in a
way that is courteous and professional. Typically, this
is either a flight from one location to another, or a flight that
starts and ends at the same location. Appropriate
communication with others regarding your flight intentions is expected,
and a lack of communications regarding your intentions will
be disruptive to others operating in the same area. As you gain
experience within the environment, your judgement regarding what
is disruptive, and what is not, should continue to develop. If
you are new to the environment, your attention should be focused on
observing others around you, and making sure that you are communicating in
such a way that you will not cause any conflicts or disruptions.
When familiarizing yourself with the environment, it is recommended that
you focus on simple flight operations, and aircraft that are appropriate
for your skill level and location. Choosing to use complex
aircraft, in busy areas (especially those used for training), and
participating in flight operations that are beyond your ability to
communicate and manage in a professional and courteous manner
is almost certain to cause disruptions. 8.
HOW CAN I IDENTIFY A SERVER ADMIN OR INSTRUCTOR PILOT WHILE USING THIS
ENVIRONEMENT? All Hovercontrol Instructor Pilots and Staff Members are
server administrators for this environment. Staff Members and
Instructor pilots will clearly display their callsign, name, and status on
the Teamspeak user nickname. For example: HC123AB_John *IP* (R
SA) would denote that John is an Instructor pilot and also a server
administrator. Staff members, Instructor Pilots, and the
community in general are normally happy to help new members get started on
the right foot. You should feel free to ask any important
questions you may have as you are familiarizing yourself with
the environment, however, keep in mind that your professional and
courteous communication is expected. If a Staff member or Instructor
Pilot is currently occupied or helping another member, your patience
and courtesy is expected and required. 9. WHAT ARE THE TOP 10
THINGS I SHOULD AVOID DOING, AS NOT TO CAUSE DISRUPTIONS? 10.
WHAT ARE THE TOP 10 THINGS I SHOULD CONSISTENTLY DO IN ORDER TO
HAVE A GOOD EXPERIENCE? 11.
IS IT REQUIRED TO HAVE VOICE COMMUNICATIONS FOR THIS ENVIRONMENT? Voice communication is the preferred method of
communication while using this environment. We use teamspeak
software for voice communications on the Hovercontrol multi-user flight
environment. You are not required to have this software in order to
connect, but nearly all experienced and active members will be using
it. In addition, training at Hovercontrol will only be performed
when voice communications are available. It is your responsibility
to communicate your flight intentions at all times, and in a courteous and
professional manner. You will find that doing this via text
communication will add a significant workload to your activities and can
be disruptive to other pilots that are attempting to stay aware of your
communications. Not communicating intentions, or communicating in a
way that is ineffective, disruptive, unclear, not concise, or otherwise
not professional or courteous will certainly cause you to disrupt
the flight operations of other members. 12. SHOULD
I EXPECT AIR TRAFFIC CONTROL IN THIS ENVIRONMENT? No. Under most circumstances there will be no air
traffic control services at the locations you are flying in this
environment. You will be expected to enter/exit airport and ground
operation areas in a structured manner that is courteous and professional,
